Performance Potential Terms and Conditions

1. Acceptance of Terms

By accessing or using the Performance Potential website (the "Website") and its services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Nature of Services

Performance Potential provides mental skills training and related services focused on mindset, wellbeing, and performance development. These services may include individual coaching, group workshops, team training, in-person or online delivery, and supportive tools such as reflective exercises, worksheets, and ongoing communication. All services are subject to separate agreements or arrangements made between Performance Potential and the client.

3. Bookings & Cancellations

Sessions must be booked in advance and are subject to availability. If you need to cancel or reschedule a session, please provide at least 24 hours’ notice. Sessions cancelled within 24 hours may be charged at the full rate, unless due to emergency circumstances.

4. Fees & Payment

Fees for services will be outlined in advance, either as individual session rates or as a package/lump sum. Invoices will be sent via email within seven days of the session, with payment due by the date specified on the invoice. Payment terms may vary based on prior agreement and will be clearly communicated.

Timely payment is expected for all services.

  • If payment remains outstanding after 7 days, a late fee may be applied.

  • Continued non-payment may result in cancellation of future sessions and/or referral to a debt collection service.

5. Mental Skills Training Is Not Medical Treatment

The services provided by Performance Potential are designed to support personal development, performance, and wellbeing through goal-setting, mindset tools, and skills-based support. These services do not include clinical diagnosis, treatment of mental health disorders, counselling, or medical advice. If during our work together, it becomes evident that psychological or medical support is needed, I may recommend or refer you to an appropriate licensed professional. Continuing to engage in coaching while needing clinical support is at your own discretion and risk.

6. Personal Responsibility and Decision-Making

All decisions made, and actions taken, as a result of coaching are your own responsibility. Coaching aims to support clarity and growth, but the implementation of tools and choices remains fully in your control. I do not guarantee any specific outcome from coaching, and results will vary depending on your level of commitment, context, and readiness.

7. Use of Tools and Techniques

Any tools, worksheets, visualisations, or strategies shared in sessions are provided in good faith as supportive frameworks. They are not substitutes for medical advice, and it is your responsibility to determine their appropriateness for your personal situation.

8. Limitation of Liability

To the fullest extent permitted by law, I (Kayla Boniface / Performance Potential) am not liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any other losses, including but not limited to emotional distress, missed opportunities, or financial loss, that may occur in connection with or arising from your use of coaching services.

In any case, my total liability- whether arising from breach of contract, negligence, or otherwise, shall be limited to the total amount you have paid for coaching services. This clause applies to both individual and group services.

9. Confidentiality

All personal information shared in sessions will be treated with respect and kept confidential, except where there is a risk of harm to yourself or others, or as required by law. Group sessions require all participants to uphold the confidentiality of their peers.

10. Intellectual Property

All materials provided (written, digital, visual, etc.) remain the intellectual property of Performance Potential unless otherwise stated. You may not reproduce, distribute, or share these materials without written consent.

11. Changes to Terms

These Terms may be updated. The most current version will always be available on the Performance Potential website or available on request. Continued use of services after changes have been made constitutes acceptance of the revised Terms.
